Terms and conditions of the ProTrails Online Community And Website.

RELEASE OF LIABILITY, WAIVER OF CLAIM, AND INDEMNITY

I understand that by my participation in outdoor activity I may encounter various hazards including but not limited to hazards posed by weather, my own physical ability, mountainous terrain, wild animals and other hazards. I acknowledge that physical activities, including but not limited to hiking, backpacking, biking, snowshoeing, mountaineering, swimming, canoeing, and traveling in mountainous terrain, can be extremely hazardous, and I am voluntarily participating in these activities with full and advance knowledge of the danger involved. The ProTrails online community is not responsible for groups, events, trips, carpools, or interactions with members of the community. I agree that I accept any and all risks of injury, death, or damage resulting from or in connection with my participation in and transportation related to these activities, even if such damages may arise out of negligence, gross negligence or carelessness on the part of any released party or any other person. I acknowledge that by agreeing to this release I am giving up substantial legal rights, including the right to sue released parties for negligence or gross negligence.

I, for myself and anyone entitled to act on my behalf, including heirs and assigns, indemnify, release, and forever hold harmless ProTrails, LLC and all of its directors, officers, guides, members, employees, agents, leaders, instructors, contractors, and volunteers, together referred to as “associates,” from my personal injury, death, or property damage, whether caused by the negligence of its associates or otherwise as a result of or in connection with my participation in ProTrails information or activities. This release shall bind all of my heirs and successors. I further this indemnification to any of my children and/or wards in connection with ProTrails activities. This document is covered by the laws of the State of Colorado, and is intended to be as broad and inclusive as permitted by the laws of the State of Colorado. If any portion of this document is held as not enforceable or valid, the remaining portions shall remain in full legal force and effect. This is a release of liability. Do not agree to the terms of this document is you do not understand or agree with its terms. Parent or legal guardian must agree for minors.
